In the name of Allah, If the sperm is from the husband and the egg from the wife so that it is fertilized externally and then placed in the womb of the wife or a foreign woman, and both cases are permissible by law, then the wife (the owner of the egg) is the mother of the child and the husband (the owner of the sperm) is the father of the boy, and the inheritance takes place between them. The owner of the womb (the foreign woman) is only an incubator; she has no right to claim incubation fees unless there is a prior agreement, and she is not a mother of the child. There are some conditions here: the process of taking the sperm from the husband is to be done in a permissible way like via the wife, no religiously forbidden act is committed like uncovering the genitals by the woman (the wife of the incubator) to the doctor, and there must be a woman doing this work. Yes, with the necessity of the doctor, it is permissible if he is in the treatment. It is forbidden to fertilize a woman with a sperm of other than her husband, and if it does, the boy who is formed from this process is attributed to the owner of the egg and the owner of the sperm and the provisions of adultery are not carried out on the process.
