I am a husband currently facing a marital problem. The legal court has already issued a divorce, but I do not want a divorce from the religious authority, as I wish to reconcile with my wife. I have read the rulings regarding divorce by the religious authority, where the authority gives the husband the choice between divorce, providing maintenance, and good companionship. My questions are as follows: 1.What is the amount of maintenance (nafaqah) that the husband is obliged to provide in order to avoid divorce by the religious authority? 2.What is meant by “living with her in kindness” from the husband’s side in order to avoid such a divorce? 3.What marital rights must the husband fulfill in order to avoid divorce by the religious authority?
Answer
In the name of Allah, the husband is obligated to provide suitable housing and accommodation for the family, as well as appropriate clothing, food, and drink in accordance with his family’s needs and his wife’s wishes within his capability. He must also be with her in bed at least one night out of every four nights and have marital relations with her at least once every four months. Allah knows best.
